TRADING TERMS & CONDITIONS OF SALE

 

Quotations

All written quotations provided by Abbode Interiors Pty Ltd to a client are valid for 14 days from the date stated thereon, unless stated otherwise in the Terms of the quote.

 

Orders

Orders will only be accepted by Abbode Interiors Pty Ltd if made in writing.

Abbode Interiors Pty Ltd reserves the right to reject any order for any reason including that the goods are no longer available, or that the order is for a quantity less than Abbode Interiors Pty Ltd’s minimum requirements.

On receipt of an order that is accepted by Abbode Interiors Pty Ltd an invoice will be generated. This may be from Abbode Interiors Pty Ltd or direct distributor. Payment in full of the invoice is required as per the payment details and terms on the invoice. An order will not be processed until full payment of the invoice relating to the order has been received and cleared.

 

Custom Orders

Indent and custom orders require a 50% deposit regardless of net terms. 

 

Storage

Unless otherwise agreed, Abbode Interiors Pty Ltd reserves the right to charge a storage fee for goods that are not collected or dispatched within 5 days of notification by Abbode Interiors Pty Ltd to the client that the goods are available for collection or dispatch.

 

Reservations

Goods reservations will be organised by Abbode Interiors Pty Ltd for a number of days advised by the distributor. Abbode Interiors Pty Ltd will advise of the end reserve date. After the specified date, the goods may be released for general sale without notification to the client.

 

Cancellation of Orders

Abbode Interiors Pty Ltd will not accept cancellation of an order by a client once the goods have been paid for and Abbode Interiors Pty Ltd has placed an order for the goods with the supplier. Cancellation of an order by a client prior to payment must be received in writing by Abbode Interiors Pty Ltd.

 

Terms of Payment

No order will be placed in relation to the goods without full payment of Abbode Interiors Pty Ltd/Distributor’s invoice. Abbode Interiors Pty Ltd reserves the right to withhold supply of goods if the Client does not comply with these terms and conditions.

Payments to Abbode Interiors Pty Ltd may be made by direct deposit into Abbode Interiors Pty Ltd’s nominated bank account (details on the Abbode Interiors Pty Ltd invoice or as otherwise advised) or by MasterCard, Visa, within time period set out in the invoice. Note: if payment is made by Direct Deposit, Abbode Interiors Pty Ltd requests that the Client email through a bank remittance to ensure prompt processing of the Client’s Order.

Any payment made by credit card will attract a surcharge.

 

Delivery

All prices quoted are for delivery to a one address only within Metropolitan and regional areas and are inclusive of all duties, transport, postage and insurance. Deliveries will generally be made from Monday-Friday between the hours of 9am-5pm, unless otherwise agreed upon. If delivery is required outside of these times, discuss alternate delivery options with Abbode Interiors Pty Ltd prior to confirming the final order.

The Client is responsible for any international delivery costs if it is not being delivered within Australia and will have to arrange for payment of freight, duty and taxes (GST not included). Abbode Interiors Pty Ltd will be happy to organize this for you and an invoice will be raised.

Estimated times of arrival are estimates only and are based on advice provided by Abbode Interiors Pty Ltd’s suppliers. Abbode Interiors Pty Ltd is not responsible for any delays

in delivery that may occur due to circumstances beyond Abbode Interiors Pty Ltd control. If Express delivery is required, a quote will be provided. If accepted, the Client shall bear all costs for this service, which Abbode Interiors Pty Ltd is happy to arrange on your behalf, and an invoice will be raised.

 

Product Suitability & Liability of Supplier

The Client is wholly responsible to determine the suitability of the goods for its specific and end use.

Except as provided in these terms and conditions, to the extent permitted by law, all express and implied warranties, guarantees and conditions under statute or general law as to merchantability, description, quality, suitability or fit for purpose of the goods supplied, or as to design, assembly, installation, materials or workmanship or otherwise, are expressly excluded.

The Supplier’s liability for a breach of a condition or warranty under these terms and conditions or implied by statute which may not be excluded, is limited to any one of the following as determined by the Supplier:

  • replacement of goods or the supply of equivalent goods;

  • repair of goods;

  • payment of the cost of replacing the goods or of acquiring equivalent goods;

  • payment or the cost of having the goods repaired; or

  • in the case of services, the supplying of services again or the payment of the cost of having the services supplied again.

 

Claims & Returns

Claims in relation to goods supplied by Abbode Interiors Pty Ltd on behalf of companies represented must be notified by the Client to Abbode Interiors Pty Ltd in writing within 7 days of delivery of the goods to the Client. Photo evidence would also be requested.

All claims will then be discussed and forwarded to the supplier for further instruction for actions to be taken by Abbode Interiors Pty Ltd with the Client.

No claim can be made after goods have been cut or altered in any way after delivery.

Abbode Interiors Pty Ltd is not responsible for incorrect colour, meterage or pattern if the goods have been supplied to the Client in accordance with the Client's order. The client is responsible for checking over the details on the final invoice, prior to approving or making a payment, to ensure they are correct.

Abbode Interiors Pty Ltd is not liable for any incorrect or poor use of the goods. It is the Client's responsibility to ensure that all manufacturers’ use and installation guidelines are adhered to in relation to the goods (which will be provided by Abbode Interiors Pty Ltd on request).

Abbode Interiors Pty Ltd will only accept returns from the Client if the goods are defective, not in accordance with the Order and the goods remain uncut after delivery to the Client.

In addition to providing notification of claims within 7 days of delivery of goods to the Client as stated above, goods must be returned to Abbode Interiors Pty Ltd within 14 days of receipt by the Client. Returns of goods must be made using a carrier nominated by Abbode Interiors Pty Ltd at the Client’s cost, unless alternatively arranged with Abbode Interiors Pty Ltd.
